Blizzard recently won a decision vs. the folks over at bNetd, as we reported here (http://vanguardcrafters.pbmeyertx.com/index.php?option=com_content&task=view&id=84&Itemid=2). Any opinion on how this might impact the MMO market?
That was actually an appealed case that Blizzard already won. They enforced Blizzard's EULA and certain provisions of the Digital Millenium Copyright Act (DMCA) against what would be an emulation server in a MMOG.
It was the expected verdict. The case may go further, who knows. I have been keeping an eye on it for quite some time.
As it stands, all of those folks that (incorrectly) said that a EULA hasn't been enforced, here is a video game case where it has been.

I only partially understand what is being discussed here. Third party UI's and programs vs the EULA. This is the first time I have seen anything about it though, what does it mean for the average player?

Hopefully it means that EULAs can actually be considered a legal contract. Maybe it is good news for people who want to bring secondary market profiteers to justice.

This has been pretty universally recognized under the UCC. I'll write something up on this to clarify the state of the law (need to get some more features pumped out anyway).
